TERMS AND CONDITIONS

Simon Diez's Workshops / Classes are operated by Simon Diez Photography L.L.C.
These Terms & Conditions ("Terms" or "Agreement") apply to all Workshop/Class orders. Your order may be declined if you fail to comply with these terms.
By booking a workshop or class, you are acknowledging and agreeing to abide by these terms and conditions. If you have any questions or concerns regarding these terms, please do not hesitate to contact us.


GENERAL
1. When purchasing a workshop through this website, please note that you are directly purchasing from Simon Diez Photography. This means that any inquiries or concerns related to your purchase should be directed to Simon Diez and not any third parties or partners associated with Simon Diez. For any questions or assistance, please reach out to Simon Diez directly.
2. Purchasing a workshop ticket does not include travel or accommodations. It is the responsibility of the purchaser to arrange their own transportation to the workshop venue.
3. Attendees are expected to arrive on time and attend each day in full. If you are unable to attend, you must notify us immediately. Please note that no refund will be provided if your lateness causes you to miss all or a portion of the workshop.
4. Workshop fees must be paid in full at the time of purchase unless otherwise stated.
5. If a workshop offers multiple payment options or deposit, attendees must fulfill payments within 14 days prior to the workshop start date, unless otherwise specified. Failure to do so may result in forfeiture of your seat and a cancellation fee.
6. Unacceptable or inappropriate behavior or conduct may result in your removal from the workshop. No refund will be provided in such cases.
7. Simon Diez reserves the right to change the workshop venue or make modifications to the workshop structure. In the unlikely event of any changes, notice will be provided to all attendees as soon as possible.


FEES, CANCELLATIONS AND REFUNDS
1. Cancellation or refund requests made within 30 days of purchase will receive a full refund (unless the workshop is within 30 days of starting).
2. After 30 days from the purchase date, a fee of $250 will be deducted for any cancellations.
3. No refunds or credits will be given for workshops that are within 30 days of starting.
4. Last-minute or same-day cancellations will not be honored. If an attendee cancels within a period deemed insufficient for us not to fill their seat, they will not be entitled to a refund or credit and will lose their ticket entirely. In the event you cannot attend we recommend trying to sell your ticket to another person.
5. No exceptions, credits, or refunds will be made for attendees who are unable to arrive on time due to transportation or other issues.
6. Due to limitations with PayPal, customers who purchase using PayPal will only be entitled to a refund within 180 days due to limitations with PayPal.
Please note that Simon Diez Photography L.L.C., reserves the right to decide whether to honor repeated refund and cancellation requests for multiple workshops.

TRANSFERRING TO A OTHER WORKSHOP
Transfer requests to another workshop are subject to availability and will be considered based on the reasonable amount of time available for us to fill your spot. We cannot accommodate transfer requests if the workshop you are transferring from is already full.

WORKSHOP CANCELLATIONS
Simon Diez reserves the right to cancel a workshop due to unforeseen circumstances, illness, or other reasons. In such cases, a reasonable amount of advance notice will be provided to make alternate arrangements for attendees. If a workshop is canceled, any fees or deposits received will be refunded. Please note that travel or accommodation costs will not be refunded for canceled workshops. We recommend considering travel insurance and booking accommodations with a flexible cancellation policy.

INTERNATIONAL WORKSHOP CANCELLATIONS
For international workshops, all sales are final, and we do not offer any compensation or refunds if you are unable to attend. Please note that this policy only applies to international workshops hosted by Simon Diez.

TRAVEL / FLIGHT CANCELLATIONS
Please be advised that we do not offer refunds or options if your flight or travel arrangements are canceled or disrupted. Attendees are responsible for allowing a reasonable amount of time for travel arrangements when attending our workshops. We understand that unforeseen circumstances may arise, but we cannot be held responsible for travel delays or attendees only attending a portion of the workshop due to travel issues.

RESELLING A TICKET
If you are unable to attend a workshop, you may resell your ticket. However, it is necessary to inform Simon Diez Photography of your absence and your intention to resell your ticket. Proper entry for the buyer must be coordinated with us. Failure to do so may result in being denied entry.


IMAGE USING AND PRIVACY
1. Attendees are strictly prohibited from using workshop images for commercial purposes. Image usage is limited to portfolio use (website and online) only. Social media usage is allowed for showcasing your portfolio. Images must not be submitted to magazines, exhibitions, or competitions without permission. Images must not be used for advertising photo shoots, workshops, or products that you are selling.
2. Attendees acknowledge that participants in the workshop have not given releases allowing commercial use of any images taken at the workshop. Any unauthorized commercial use may result in legal liability. Attendees agree to indemnify and defend Simon Diez Photography L.L.C., its members, officers, employees, and all other workshop participants from any claims, losses, costs, or expenses (including attorneys’ fees and disbursements) arising from the unauthorized use of workshop images.
3. If you are unsure about permitted image usage, please contact us for confirmation. However, your obligations under paragraph 2 shall not be relieved.
4. Filming or recording the workshop without permission is strictly prohibited.


LIABILITY
Simon Diez Photography is not liable for any personal injury or property damage that occurs at the workshop venue.
Attendees are responsible for the safety and security of their belongings during the workshop. Please remember to check your equipment before leaving the workshop venue to ensure you do not leave anything behind. Simon Diez Photography is not responsible for any loss or damage to personal property.
This Contract represents the entire agreement between you and Simon Diez Photography L.L.C., superseding any prior discussions or information concerning the workshops.
